1. Who you are agreeing with
itsdad.io is owned and operated by ITS DAD LLC, a limited liability company organized in South Carolina and run by its sole owner, Brooks Walker. In these Terms, "I" and "me" mean ITS DAD LLC; "you" means the person or organization using the site or buying from it.
By using the site, creating an account, buying a digital product, or subscribing to software, you agree to these Terms. If you do not agree, do not use the site.
You must be at least 18 years old, or the age of majority where you live, to purchase. If you are buying for a company, you confirm you are authorized to bind it.
2. What I sell
Four different things are sold or offered here, and they are governed by different rules. Knowing which one you have matters:
- Digital products — one-time purchases delivered as downloadable files (PDFs, templates, prompt libraries, automation systems, courses, business resources). Governed by these Terms and the Digital Product License Agreement.
- Subscriptions and memberships — recurring access to software and hosted tools, including Overwatch. Governed by these Terms and the Subscription Terms.
- Services — consulting, build, and implementation work. Governed by a separate written scope of work signed before the engagement begins; that scope controls if it conflicts with these Terms.
- Affiliate recommendations and educational content — free articles, resources, and outbound links to third-party tools. These are information only. See the Affiliate Disclosure and Earnings Disclaimer.
3. Accounts
Some purchases create an account so you can re-download your files from your library. You are responsible for keeping your credentials secure and for activity that happens under your account.
Accounts are for one person or one organization. Sharing account credentials so that additional people obtain access they did not pay for is a breach of these Terms and of the Digital Product License Agreement.
Tell me promptly if you believe your account has been accessed without your permission.
4. Orders, pricing, and payment
Payments are processed by Stripe. I do not receive or store your full card number; Stripe handles card data under its own terms and privacy policy.
Prices are shown in U.S. dollars and exclude any tax that may apply to your location. Where sales tax or VAT is collected, it is shown before you confirm payment.
I may correct pricing or description errors. If an error affects an order you already placed, I will contact you and either honor it or refund you in full — your choice.
Confirmation of your order and your download links are delivered by email. Keep that email; it also links back to this page, the Refund Policy, and the License Agreement.
5. Delivery of digital products
Digital products are delivered electronically — normally within a minute of a successful payment — through a secure, time-limited download link sent to the email address used at checkout, plus a permanent copy in your account library where an account exists.
Download links expire for security reasons. Expired links can always be regenerated from your library or by emailing support. Expiry never means you lost the product.
If delivery fails for any reason, email support and I will get the file to you manually. You are never out a purchase because a link broke.
6. Refunds
Digital products carry a 14-day satisfaction guarantee. Subscriptions, memberships, and services follow their own rules. The complete terms, including how to request a refund and what happens to your access afterwards, are in the Refund Policy, which forms part of this agreement.
7. License and intellectual property
All content on this site and inside the products — text, designs, code, templates, prompts, systems, brand names, and the ITS DAD marks — is owned by ITS DAD LLC or licensed to it, unless credited otherwise.
Buying a digital product does not transfer ownership. It grants you a license to use it, described in full in the Digital Product License Agreement. Reselling, redistributing, or republishing the products is not permitted.
Ownership of custom work produced in a services engagement is defined in that engagement's written scope, not here.
8. Acceptable use
You agree not to misuse the site, the software, or the products. Prohibited conduct is listed in the Acceptable Use Policy and includes unauthorized access, disruptive scraping, reverse engineering paid software, reselling licensed material, and using anything bought here to break the law or harm others.
I may suspend or terminate access, without refund, for a material breach of the Acceptable Use Policy.
9. AI-assisted content
Some products, tools, and content are produced with AI assistance, and some tools generate output for you at the moment you use them. AI output can be wrong, out of date, or unsuitable for your situation. You are responsible for reviewing anything you rely on. Read the AI Disclaimer before using AI features.
10. No guarantee of results
The products and content are educational and operational tools. They are not a guarantee of income, growth, hiring, funding, ranking, or any other business outcome, and nothing here should be read as financial, legal, tax, or professional advice. See the Earnings Disclaimer.
11. Third-party services and links
The site links to third-party tools, some through affiliate links. Those services are controlled by their own terms and privacy policies. I am not responsible for their availability, content, pricing changes, or how they handle your data.
12. Availability and changes
I run this business alone and I do not promise uninterrupted availability. Software, features, product catalogs, and pricing can change, and individual products can be retired.
If a product you own is retired, your download access and license continue. If a subscription product is discontinued, I will give you reasonable notice and will not bill you for a period you cannot use.
13. Disclaimer of warranties
The site, the products, and the software are provided "as is" and "as available." To the maximum extent permitted by law, I disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow these exclusions, in which case they apply to the extent permitted.
14. Limitation of liability
To the maximum extent permitted by law, ITS DAD LLC and its owner are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of your use of the site, the products, or the software.
Total aggregate liability for any claim relating to the site, a product, or a subscription is limited to the amount you paid me for that product or subscription in the twelve months before the claim arose.
Nothing here limits liability that cannot be limited by law, including for fraud.
15. Indemnity
You agree to indemnify and hold harmless ITS DAD LLC and its owner from claims, damages, and reasonable costs arising from your breach of these Terms, your misuse of the products, or your violation of any law or third-party right.
16. Termination
You can stop using the site at any time and cancel any subscription from your account. I may suspend or close an account for a material breach of these Terms or the Acceptable Use Policy. Sections that by nature should survive termination — license restrictions, intellectual property, disclaimers, limitation of liability, indemnity, and governing law — survive it.
17. Governing law and disputes
These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law rules. You and I agree to the exclusive jurisdiction of the state and federal courts located in South Carolina.
Before filing anything, email support@itsdad.io with a plain description of the problem. I am one person and I would much rather fix it than litigate it. Most disputes here are a refund away from resolved.
18. Changes to these Terms
These Terms may be updated as the business changes. The effective date at the top of this page always reflects the current version. Material changes affecting active subscriptions will be emailed to subscribers before they take effect. Continuing to use the site after a change means you accept the updated Terms.
19. Entire agreement
These Terms, together with the policies they reference — Privacy Policy, Cookie Policy, Refund Policy, Digital Product License Agreement, Subscription Terms, Acceptable Use Policy, AI Disclaimer, and Earnings Disclaimer — are the entire agreement between you and me for site use and purchases. A signed services scope of work controls for that engagement. If any provision is found unenforceable, the rest stays in force.
